This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you visit our website (spadeandco.com), use our mobile application ("Spade & Co App" or "App"), connect or use our wearable devices ("Devices"), or interact with any of our products or services (collectively, the "Services").

By using our Services, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please discontinue use of our Services.

1. Information We Collect

1.1 Information You Provide

Account Information: When you create an account on our App, we may collect your email address, password, date of birth, gender, height, weight, and country or region. You may also optionally provide a nickname, weight goal, step goal, and profile picture. This information is used as part of our health data algorithms (for example, heart rate algorithms generate more accurate data based on your age, height, and weight).

Order and Transaction Information: When you place an order through our website, we collect your name, email address, phone number, shipping address, and billing address. We do not store your credit card or debit card information directly; payment processing is handled by third-party payment processors.

Communications: When you contact us via email, chat, phone, or through our in-app feedback feature ("Contact Us"), we collect the information you provide, including your name, email address, and the content of your message.

Survey and Feedback Information: If you participate in surveys, promotions, or provide product reviews, we collect the information you submit.

1.2 Information Collected Automatically Through the App and Devices

Exercise and Health Data: When you use our Devices and App, we may collect steps, distance, speed, exercise time, calories burned, sleep duration and quality, heart rate, blood oxygen saturation (SpO2), stress levels, exercise type, detailed exercise history, and related wellness metrics. This data is encrypted and is used to provide you with personalized health and fitness feedback. You may opt out of specific features to stop the collection of related data.

Location Information: With your permission, we collect location data to provide weather updates to your Device, display your outdoor exercise route (GPS tracking), search for nearby Bluetooth devices during pairing, and help you select your region during account setup. You may turn off location permissions at any time through your phone's settings.

Device and Technical Information: We collect device-related information including your Device MAC address, device version number, serial number, firmware version, App version, phone operating system version, IP address, network type, and device configuration. This information is used for firmware updates, App updates, troubleshooting, and improving our Services.

Log Information: We may collect usage data when you use our Devices or App, including account creation or login events, device pairing information, device reboot information, network usage data, and information on system errors, crashes, and upgrades. Log data from the past 7 days is stored locally on your phone and is not uploaded to our servers unless you choose to submit it through our feedback feature.

Bluetooth Data: Our App uses Bluetooth to connect to and communicate with your Device. During this process, we collect Bluetooth connection data necessary for pairing, syncing, and maintaining your Device connection.

1.3 Information Collected Through the Website

Browsing Information: We collect information about your visits to our website, including your IP address, browser type, referring/exit pages, pages viewed, time spent on pages, and clickstream data.

Cookies and Tracking Technologies: We use cookies, web beacons, pixels, and similar technologies to enhance your browsing experience, analyze website traffic, and serve targeted advertisements. You can manage your cookie preferences through your browser settings.

1.4 Information from Third Parties

We may receive information about you from third-party sources such as social media platforms (if you interact with our social media content), advertising partners, and analytics providers.

Service Providers: We share information with third-party service providers who perform services on our behalf, such as payment processing, order fulfillment, data hosting, analytics, email delivery, and customer support. At Your Direction: If you choose to share your health or exercise data with third-party services (such as Apple Health or Google Health Connect), we will share the requested data at your instruction. Your use of those third-party services is governed by their respective privacy policies.

Legal Requirements: We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

Business Transfers: If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

4. Third-Party Service Providers

Our Services rely on certain third-party providers:

Cloud Storage: Our cloud storage is provided by Amazon Web Services (AWS). When cloud sync is enabled, your personal information, exercise data, and health data are uploaded to AWS servers. You may disable cloud sync in the App settings or clear your cloud data at any time.

Map Services: Our App uses Google Maps SDK to display your outdoor exercise routes. When you use map features, your location information is provided to Google. Please refer to Google's privacy policy for more information.

Weather Services: If your Device supports weather notifications, your location information is sent to our weather service provider to deliver local weather data to your Device. You can disable weather notifications in your Device settings at any time. Your location information is anonymized for this purpose.

Payment Processors: Payments on our website are handled by third-party payment processors. We do not collect or store your payment card information.

Analytics: We use analytics tools (such as Google Analytics) to understand how our website and App are used. These tools may collect information about your usage patterns.

5. Data Security

We implement administrative, technical, and physical safeguards to protect your personal information, including encryption of health data both in transit and at rest. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

6. Data Retention and Deletion

We retain your personal information for as long as you maintain an active account with us or as needed to provide you with our Services. If you cancel your account or request deletion of your data, we will delete or anonymize your information within 90 days of your request, unless we are required by law to retain it for a longer period.

Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. By using our Services, you consent to the transfer of your information to countries that may have different data protection laws than your country of residence. We take appropriate safeguards to ensure that all data transfers comply with applicable law.

8.1 General Rights

You have the right to:

  • Access your personal information collected by us
  • Correct inaccurate or incomplete personal information
  • Delete your personal information (subject to certain legal exceptions)

  • Right to Delete: You have the right to request deletion of your personal information, subject to certain exceptions.
  • Right to Correct: You have the right to request correction of inaccurate personal information.
  • Right to Opt Out of Sale or Sharing: We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising.

  • Sensitive Personal Information: Health data collected through our Devices and App (such as heart rate, SpO2, sleep data, and exercise data) is considered sensitive personal information under California law. We use this information only to provide our Services to you and do not use it for any purpose other than what is necessary to deliver our Services.

In the preceding 12 months, we have collected the following categories of personal information: identifiers (name, email, address), commercial information (purchase history), internet activity (browsing data, App usage), geolocation data, and health-related information (exercise and wellness data from Devices). We have not sold any personal information.

8.3 Rights of EU/UK Residents (GDPR/UK GDPR)

If you are a resident of the European Economic Area (EEA) or the United Kingdom, you have additional rights under the General Data Protection Regulation (GDPR) or UK GDPR:

Our Services are not directed to children under the age of 13 (or under the age of 16 in the European Economic Area and United Kingdom). Health data provided by Spade & Co Devices and the Spade & Co App, including but not limited to heart rate, blood oxygen saturation (SpO2), sleep tracking, step counting, calorie estimates, and stress measurements, is for informational and general wellness purposes only. This data is not intended for medical diagnosis, treatment, cure, or prevention of any disease or health condition. Always consult a qualified healthcare professional for medical advice, diagnosis, or treatment. Do not disregard professional medical advice or delay seeking it based on information obtained through our Services.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by updating the "Effective Date" at the top of this page and, where appropriate, through the App or by email. We encourage you to review this Privacy Policy periodically.
